The court has approved a provisional attachment on copyright claims filed by the talent agency, ATTRAKT, against Ahn Sung Il, the CEO of The Givers.
On September 25, ATTRAKT asserted, "We found out that Ahn Sung Il of The Givers has been misappropriating the company's funds while rendering services for ATTRAKT. In response, we applied for provisional attachment of copyright fees as compensation for the embezzled funds, requests that the court has since granted."
Current payments of copyright fees for FIFTY FIFTY's debut album 'THE FIFTY' and 'The Beginning: Cupid,' that are both registered to Ahn Sung Il with the Copyright Association, have been put on hold.
ATTRAKT has indicated its intent to apply for provisional attachment on the remainder of the funds in light of additional embezzlement and breach of trust allegations facing Ahn Sung Il from The Givers.
In a related turn of events in June, ATTRAKT CEO, Jun Hong Joon, lodged a police complaint against three individuals, including The Givers CEO Ahn Sung Il, on charges of fraud, breach of trust, and obstruction of business.
Jun Hong Joon posited that Ahn Sung Il and his associates sought to poach the FIFTY FIFTY members through Warner Music Korea, FIFTY FIFTY’s overseas distributor. He also claimed The Givers secretively bought the "Cupid" sound source copyright from an overseas composer, withholding such information from ATTRAKT.
The Givers denied any wrongdoings in response to these accusations and vowed to take legal action. The FITY FIFTY members also submitted an application for a preliminary injunction, expressing their desires to terminate their exclusive contract with ATTRAKT, citing the reasons as violations of obligation in providing adequate settlement data, breaches in member health management, and lack of sufficient human and material resources.
However, the court's judgment determined that FIFTY FIFTY failed to provide substantial reasons for terminating their contract, thereby allowing the members to remain with ATTRAKT. This ruling led to FIFTY FIFTY's decision to mount an immediate appeal and assert their determination to continue the legal battle through a lawsuit on the merits.
