Girls' Generation and Jang Dong Gun have lost their lawsuit against an optometrist and his cosmetic clinic that allegedly used their image without permission.
The lawsuit was filed back in January at the Seoul Central District Court, where SM Entertainment said, "People can access their site just by looking up our names on the internet. This will mislead people into thinking we have connections to the clinic or have had plastic surgery in the past."
However, they lost the lawsuit at the hearing that took place on the 13th. The judge ruled, "It's not that Doctor Kim had purposely used the images himself, but that the others used it [directing to the website]. There is no evidence that points to saying that Doctor Kim should be held responsible for the use."
In other words, the judge ruled that since it was internet users uploading images that directly affected the results and links to the website and not Doctor Kim himself, he shouldn't be held responsible.
However, the agency said, "We will definitely appeal this ruling". On the celebrities' separate suit on their portrait rights, the agency said, "We cannot give you the details because it is an ongoing legal matter."
