Previously, singer Gary found himself entangled in a controversy when an alleged sex tape involving the singer was leaked on-line. However, it was proven to not be Gary but someone who looked similar to him in the video. The man and woman in the sex tape were deemed victims with the man asking Gary's agency to please take care of the situation and the woman's husband relaying how she is suffering from all this.

The first circulator of the video, A (32), received a sentence for first spreading the video under the pretense of 'Gary's sex tape.' He was revealed to be a Level 5 public servant who used to be a doctor. On February 29, he was sentenced to eight months in prison. The court also ordered him to attend 80 hours of a sexual assault treatment program.
Back in early 2014, he had first circulated the alleged sex tape of Gary to two unidentified male individuals through internet messenger, 'Nate On,' and adult side, 'Sora Net.' He was also charged with engaging with eleven male prostitutes whom he met through advertisement on an adult site for gay men from May to August last year, but that is not all. He was investigated for filming his sexual relations with the men with a camcorder without their consent.
The court said on February 29, "While sleeping with multiple male prostitutes, the accused secretly filmed them, which is an extremely severe criminal offense. The harm, such as the violation of the personal rights of the people who appear in the videos, is large, so there needs to be a severe punishment. We acknowledge his criminal act, which was his first offense with no criminal record in the past, and took into consideration that he is self-reflecting."
