At his first trial held on November 5, Choi admitted to his charges; however, he claimed that he was "not in the right state of mind because he was intoxicated." Following this claim, another trial may be held to determine the validity behind Choi's intoxication assertion. In response to Choi, the plaintiff, identified as Kim, said, "Choi was on his fourth round of drinks. He gave the excuse that he did it because he was drunk."

Kim's attorney said, "Defendant Choi admitted to the charges and all the evidence submitted by prosecution, so the issue of the deleted dash cam footage holds no meaning."
It was reported that Choi's driver Mr. Oh was present at the trial. Further, Choi was said have chosen an acquaintance who was at the gathering to stand in as his witness at his hearing.
Plaintiff Kim has also selected an acquaintance from the gathering to be her witness, and another trial aside from the one to determine Choi's intoxicated state is planned to be held. The second trial will be held on the 17th of next month.
