The prosecution has officially indicted President Yoon Suk Yeol on charges related to his declaration of martial law.
This marks a groundbreaking moment in South Korea’s constitutional history, as no sitting president has ever been indicted and brought to trial while under detention. With President Yoon's indictment, seen as the "pinnacle" of the investigation, the case has effectively reached its conclusion.
The Special Investigation Headquarters for Martial Law, led by Senior Prosecutor Park Se Hyun, announced on the 26th that President Yoon had been indicted under detention for allegedly orchestrating a rebellion aimed at undermining state authority and disrupting the constitutional order.
President Yoon stands accused of declaring an unconstitutional and unlawful state of martial law and attempting to detain key figures, including members of the National Assembly, without warrants to prevent the repeal of martial law.
On the same day, the Presidential Office expressed regret over President Yoon's indictment on rebellion charges, which coincided with the start of the Lunar New Year holiday. According to Kyeongin Ilbo, the office stated, "This indictment is both unlawful and unjust, an opportunistic act that rides on the prevailing atmosphere."
While no formal statement followed the prosecution's decision, the Presidential Office conveyed deep disappointment over the unprecedented detention and indictment of a sitting president. A senior official remarked, "It is profoundly regrettable and disheartening that the President of the Republic of Korea, our head of state, has been unlawfully and unjustly detained and indicted."
President Yoon’s indictment comes 54 days after the declaration of the 'December 3 Martial Law.'
For now, President Yoon will not undergo further investigation by the prosecution. Instead, he will defend himself against the rebellion charges in court while remaining in detention. During the trial, he will be transported in a secure vehicle to and from the Seoul Central District Court, accompanied by a security detail to ensure his safety.
