There are now opinions from law experts that Don Spike may have appeared on Channel A's 'Oh Eun Young's Golden Counseling Center' (hereinafter 'Golden Counseling Center') with the goal of receiving a lighter sentence.
On September 29, former entertainment reporter turned YouTuber Lee Jin Ho uploaded a video titled, "The real reason Don Spike appeared on Golden Counseling Center | I asked a former chief prosecutor."
In the video, Lee Jin Ho talked with attorney Yoon Jae Pil, a former prosecutor in the Department of Violence, about Don Spike's drug scandal.
Attorney Yoon explained that the reason Don Spike's three previous drug charges were not known to the public is that personal information is protected under the Personal Information Protection Act. Therefore, the investigative agency could not disclose that information before.
On this day, Lee Jin Ho and attorney Yoon Jae Pil also pointed to Don Spike's hairstyle that he has been keeping for many years. The former chief prosecutor explained, "One of the hairstyles that people who habitually use drugs is dyed hair or shaved hair. I can't say for certain that (Don Spike has that style) it is for that reason but hair is a very important piece of evidence when it comes to drug cases. However, there are people who are related to drugs who keep their hairs shaved."
Additionally, Don Spike recently appeared on 'Golden Counseling Center' and received counseling from Dr. Oh Eun Young. On the show, Dr. Oh Eun Young stated that Don Spike seems to have four egos, and he might be on the autism spectrum. The former chief prosecutor speculated that Don Spike recently appeared on the show in order to receive a lighter sentence.
Attorney Yoon Jae Pil explained, "A mental and physical weakness becomes a reason for the reductions of the sentencing only with the diagnoses or judgment from an expert. It is difficult to receive reduced sentencing just to claim one has mental instability."
He continued to explain, "There are necessary considerations taken in determining the sentencing when an individual has a mental disorder to the extent that it is impossible for that person to make an ideal judgment. This is called 'reasons for reducing the amount of punishment.' This reason might be applied to this case."
Lee Jin Ho raised the question of whether a video of the broadcast of 'Golden Counseling Center' can be submitted as a supporting document, and the attorney responded, "It is clearly something that can be used to support an argument."
