The actor surnamed Kwon (male, 28) was given a probation sentence in the first trial with allegations of taking funky balls (laughing gas nitrous oxide) which caused illusion out of a closed pub.
On July 29, Judge Lee Gi Hong of Criminal Division No. 24 of Seoul Central District Court sentenced Kwon to 4 months in prison, 2 years' probation after he was prosecuted for charges of violating chemical management law (using hallucinatory substances in particular) and trespassing on a private facility.
The judge explained, "The defendant was aware that the pub was closed, but still got in the business to buy laughing gas. It can be seen that the defendant was waving money in front of the camera at the scene, which cannot be viewed as an act of thinking the shop was open or had staff inside." In addition, the judge criticized that Kwon was constantly inhaling laughing gas in collusion with others.
However, the Judge also explained the reason of reducing the punishment, "The court takes into consideration that the offender commits violation for the first time and is showing sincere repentance for his act of providing and using nitrous oxide."
Kwon was found guilty of entering a closed pub in Yeongdeungpo District, Seoul, when he came to this establishment to buy funky balloons in February. The investigative results showed that, at that time, Kwon left 50,000 won at the pub with no staff and took about 100 laughing balloons and left.
