Kim Sang-Kyo, aged 34 and initially known as the first informant in the "Burning Sun" nightclub scandal, has been found guilty of sexual harassment charges.
The Seoul Central District Court's Criminal Appellate Department 1-3, presided over by Senior Judges Kim Hyung-jak, Im Jae-hoon, and Kim Soo-kyung, upheld the previous verdict. Mr. Kim received one year in prison with a two-year suspended sentence, consistent with the first court's decision. This is basically probation, meaning he will only serve a 1 year prison sentence if he breaks his probation over a 2 year period. The court also reaffirmed the requirement for Mr. Kim to attend 40-hour sexual violence treatment lectures and complete 80 hours of community service.
The court stated: "Regarding the sexual harassment charges, we affirm that the defendant's actions are sufficiently proven." They added, "Video footage showing the harassment substantiates these charges, making the claim of post-manipulation by the club implausible."
Concerning the charges of business obstruction at the club, the court noted: "The defendant's actions, including throwing a trash can, hindered the club's operations and cannot be justified," thus rejecting Mr. Kim's defense of factual error and legal misconception.
Mr. Kim was accused of sexually harassing three women at the Burning Sun Club on November 24, 2018, and of obstructing business by causing a disturbance. His actions gained attention during the Burning Sun scandal, which involved allegations of police collusion with the nightclub.
Investigations, including analysis of CCTV footage and victim statements, led to Mr. Kim's indictment in January 2020. They confirmed harassment against three women and the obstruction of business. While the first trial acquitted Mr. Kim of harassing two of the women, it found him guilty of harassing the third and of obstructing the club's operations.
