The Military Prosecution changed the indictment of Seungri's aggravated assault incitement charges due to lack of evidence.
Regarding Seungri's aggravated assault incitement charges, the military prosecution stated during their closing argument on the last try: "There is no evidence, so we will change the indictment to a joint principal offender of the aggravated assault incitement charges"
The defendant's questioning of Seungri was conducted at the Ground Operations Command's General Military Court located in Yong-in City, Gyeong-gi Province morning of July 1. Following the 11 hours of questioning on the previous day.
During it, the military prosecutors have revised the charges of inciting aggravated assault (that they suddenly announced in the middle of the trial after investigations finished months prior) They said, "In case of the indictment facts, Yoo In-seok came and (Seungri) asked him to call someone who would exert power on others. But in the process that a third party called in a gang, there is no connection to Seungri, and Seungri also denying (it) and there is even no evidence", while said, "Seungri heard from Yoo In-seok that the people he called would come and waited for them. We believe that an implicit agreement has been reached, and the inciting aggravated assault charges is suspected of joint principal offenders."
Seungri's legal representative (asked for confirmation) confirmed (by asking), "Is it right that it isn't calling someone to exercise their power, but the person who asked for the exercise of power has been changed to Yoo In-seok?" The military prosecutors explained, "It's not an active conspiracy, but he heard from Yoo In-seok and waited together. There was an implicit agreement."
The military judge heard both sides and approved the proceedings to change the indictment. The legal representative said he will reveal position through writing and opinion document.
Netizens start sharing their confusion and anger about the changes, as they wrote:
"I'm stunned. How can that be allowed? In which country can it be allowed to simply change the charges in the closing argument without a chance that the defendant could say or do anything?"
"Sorry but, they are insane ...what even is this"
"Adding indictments and changing status at the end of the trial during closing statements what kind of law system is this?"
"Speaking as a person who studies law, I think it’s really weird. Prosecutor shouldn’t change the indictment in the last trial before verdict. How about the pleads? It’s clear that the indictments are invalid. If they really need to change the indictment it should be donebefore the trial even started."
"What the ****? When it's nearing the end, you gonna change the indictment? This is a desperate move"
"They don't have ANY evidence, they don't have any witnesses, but somehow judge (who is supposed to be unbiased and fair) allowed them to change the charges last second. I am disgusted!"
"it shows SO MUCH corruption in their justice system when a prosecution has had a case for way over a year and adds a new indictment near the end of a trial, and then changes the status at the end. It's mind boggling"
When you have no evidence for a charge, but you're desperate to make anything stick lol.
