Kim Jung Hoon (age 44) has been sent to the prosecution without detention on charges of refusing a breathalyzer.
On February 8, the Suseo Police Station in Seoul announced that Kim Jung Hoon was forwarded to the prosecution without detention, facing charges of violating the Road Traffic Act by refusing to take a DUI test, as well as the Special Act on Traffic Accident Handling for causing injury.
The incident unfolded in the early hours of December 28 last year, when Kim Jung Hoon was involved in a collision, rear-ending another vehicle on the Southern Circulation Road in Ildae-dong, Gangnam-gu, Seoul, at around 3:30 AM.
Responding promptly to the incident, police officers arrived at the scene. Despite their repeated requests, Kim Jung Hoon refused to submit to a breathalyzer, leading to his charge for refusing the test under the Road Traffic Act.
Initially, the investigation treated Kim Jung Hoon as a potential victim. However, further inquiry revealed his considerable fault in the accident, leading to an additional charge of causing injury.
The collision resulted in minor injuries for the driver of the other vehicle, and thus, Kim Jung Hoon faced further charges under the Special Act on Traffic Accident Handling for his role in causing the injury.
This incident marks not the first but a repeat offense for Kim Jung Hoon, who previously encountered legal trouble for a DUI traffic accident in July 2011, an event that led to the revocation of his driving license.
