According to reports on May 26, former B.A.P member Himchan (Kim Him Chan, 32) is facing a new lawsuit for sexual molestation, while still in the process of appealing his sexual assault lawsuit from 2019. 

Recent legal reports stated that two women filed a lawsuit against Himchan in April of this year, claiming that Himchan sexually molested them on an exterior staircase at an establishment in Yongsan-gu, Hannam-dong. One of the two women involved was a foreigner. 

According to the two women, Himchan took one of the women's phones while they were waiting for their food to arrive. The two women then confronted Himchan on an exterior staircase, when Himchan touched the waste of one of the women and asked that they "go upstairs together". The other woman also claimed that Himchan attempted to touch her chest. Both claimed that Himchan was severely drunk during the incident.

Immediately afterward, the women complained to the establishment's owners, and a manager appeared and sent Himchan home in a taxi. The women, who discovered later on that Himchan was a celebrity currently involved in a sexual assault lawsuit, visited the Yongsan police station that same evening to file charges against him. 

However, according to a statement given by Himchan's legal representative, "Based on CCTV footage from the scene, the contact between Himchan and the two women occurred due to inevitable circumstances, but there was no sexual intent. The contact occurred when other customers attempted to traverse up and down the narrow staircase. If the women felt offended by contact which resulted from these inevitable circumstances, the defendant apologizes. Again, the defendant did not attempt to touch the women's chests, and he had no sexual intent toward either." 

Meanwhile, Himchan was previously indicted for sexually assaulting a woman in September of 2019. In February of last year, he was sentenced to 10 months in prison after pleading guilty during his initial trial. Himchan then appealed the court's initial decision, and is scheduled to attend a second appeal trial hearing in June.
