A 40-year-old woman, identified only by her surname, Shim, was indicted for raping her husband, identified by his surname, Kim.
This case is the first incident in which a wife has been charged with marital rape in Korea. The Supreme Court only ruled back in May of 2013 that spousal rape is grievous enough to be deemed a crime.
According to prosecution, Shim tied up her husband, locked him up for 29 hours, and forced herself on him, with the goal of gaining an advantage for the divorce proceedings.
Attorney Choi Dan Bi stated, "The reason for locking up her husband for two days was to gain an advantage in court. Isn't it important in divorce proceedings whose fault it is that the marriage crumbled? Hence, the woman threatened for her husband to testify that fault lies with him."

It was reported that Shim and Kim had a falling out when they were living abroad together in England. They both returned to Korea to go through the legal steps required to divorce each other. Shim, in order to tip the scales in her favor, had hatched a plan to lock Kim up with the help of an accomplice. Fortunately, Kim was able to escape and reported what happened to the police. While Shim is claiming that the sex was consensual, Kim retaliated that he only obliged because he felt his life was threatened.
